1. General

Wilkintie is a project of the business New Moon.

These terms and conditions apply to customers of the Wilkintie and New Moon websites.

New Moon may change these Conditions at any time. All items are advertised for sale in good faith and New Moon will use due care and skill in packaging and dispatching purchases to you.

2. About Wilkintie and New Moon

Wilkintie is an independent entity set up to promote the various artistic and business projects of Carly Hargreaves and Niels Oeltjen (New Moon). This online store, Wilkintie, sells the work of various artists. When creating our edition products we strive to use small-scale producers or work in collaboration with other artists and craftsmen.

3. Orders


Wilkintie.com is not a wholesaler and any entity who resells the goods provided by this store without the written permission of New Moon is in violation of the conditions of this online store. New Moon may prosecute offenders to the full extent of the law.

The sale of all items via New Moon’s online store is subject to availability. When making an order using the online forms you must follow all the instructions and provide all information required. All prices, taxes, the volume of items and any other details included on the online forms apply to your purchase. New Moon will send your purchase and any communications to you at the contact details you provide on the order form, and will not be responsible for any errors in this information. You will be sent an email confirming your order and receipt of payment. New Moon may prosecute offenders to the full extent of the law.

4. Payment

All prices are in Australian dollars. Payment of the correct price must accompany all orders. Prices are subject to change without notice, however you will only pay the price that is advertised for the item at the time you place your order. PayPal™ is our secure payment gateway and our customers and New Moon are bound to the terms and conditions as stated by PayPal™.

5. Taxes

Prices for items sold within Australia do not currently include Australian Goods and Services Tax (’GST’). This is subject to change at any time. Prices for items sold outside of Australia do not include GST. If you are making your purchase from outside of Australia you must pay any local duties or taxes (eg. customs or import taxes) that apply in your country of purchase — New Moon does not take responsibility for these.

6. Postage

Postage and Handling

Australian Delivery

Australian orders are sent via Australia Post.

International Delivery

International orders are sent via Australia Post. New Moon does not take any responsibility for meeting any legal requirements of the country of delivery.

7. Delay in Delivery

Delay may occur as a result of factors such as supply problems or unexpected demand, however, New Moon will endeavour to despatch your order within 7 working days of purchase, or, in the case of subscription, at the beginning of every month. Although most postings arrive within 2 weeks please allow a maximum period of 6-8 weeks from the time of order to delivery.

8. Cancellation

New Moon may cancel your order if an item is unavailable or if there is an error in the price or description of the item, or in the order. If your order is cancelled New Moon will refund your payment.

9. Refusal of Sale

New Moon reserves the right to cancel any order for any or all of the following reasons:
a) If we believe that order may constitute an attempt to commit a fraudulant act.
b) If we believe that it is an attempt to buy our goods in order to sell them on.
c) If the purchaser has been previously been banned from our store for improper conduct.

Bans are binding until notice is given by us lifting the ban.
If your order is refused New Moon will refund your payment.

10. Bans

New Moon reserves the right to ban from using our store any individual, company, group, collective, or any other entity who contravenes our terms and conditions. It is the responsibility of the banned entity to prove their case should they wish to be removed from the banned list.

11. Returns and Exchanges

New Moon examines all prints thoroughly and packages carefully for quality control. All damages incurred through postage are not the responsibility of New Moon. There are no refunds or exchanges for customers changing their mind. New Moon will consider exchanges or refunds under very special circumstances. Please email us if you have a query.

12. Refunds

New Moon will refund your payment if the item you wanted to purchase is unavailable. Refunds will be made to the credit card account used to place the order and no other.

13. Exclusion and Limitation of Liability

New Moon excludes all representations, terms and conditions relating to your purchase from the New Moon’s online store, apart from those within this document. New Moon will not be liable for any indirect, incidental, special and/or consequential losses or damages or loss of profits whatsoever (including arising from any act or omission by New Moon) in connection with your use of or inability to access the online store or make a purchase, or any material or information or product purchased from the online store. To the extent permitted by law New Moon excludes all statutory or implied conditions and warranties and limits New Moon s liability under any condition or warranty which cannot legally be excluded to, at New Moon’s discretion, resupply of the goods or services (or equivalent) or payment of the cost of having the goods or services resupplied. The functions of New Moon’s online store may sometimes be interrupted by server outage and technological problems. While New Moon will make reasonable efforts to ensure continuous online services New Moon does not take any responsibility for any inconvenience or consequences affecting your order, including the loss of your order.

14. Security

New Moon uses a contracted service provider to securely process your online credit card payments. This provider is PayPal. When you purchase an item from New Moon’s online store your credit card details are only processed by New Moon’s contracted service provider and New Moon does not record or store this information. While New Moon contracts with a service provider to provide a secure system New Moon does not and cannot take responsibility for the security of information during transit over the internet.

15. Personal Information

New Moon collects your personal information when you make a purchase via our PayPal page to help to process your order. New Moon may disclose your shipping information to Australia Post for the purposes of delivering your order. New Moon also retains your order details (but not credit card details) in a secure system to help manage your order. New Moon uses your personal information under the terms of the New Moon terms and conditions.

16. Privacy

Your personal information is collected to enable us to process your order. New Moon will not share (ie sell, rent, trade, or disseminate) your personal information with any third parties or any other entities. We will only use your information for our business purposes, and will treat your information as private. We are committed to protecting your privacy. In this clause, ‘personal information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion. {see Privacy Act 1998 Commonwealth}. Your email address will never be sold. It will only be used in accordance with our Privacy Policy.
